Agreement to Terms

Welcome to lymiq. These Terms of Service ("Terms") govern your access to and use of the lymiq service, including our website at lymiq.io, our API, and our Model Context Protocol (MCP) integration (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Description of Service

lymiq is a diagram generation platform that transforms natural language descriptions into professional, presentation-ready architecture diagrams. The Service includes:

  • Web-based diagram generation interface
  • Natural language processing for diagram creation
  • Iterative diagram refinement capabilities
  • Model Context Protocol (MCP) integration for development tools
  • Keyboard shortcuts for efficient navigation
  • Diagram export and sharing features

Account Registration and Security

Account Creation

To access certain features of the Service, you must create an account by providing:

  • A valid email address
  • A username
  • A secure password

You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security and confidentiality of your password
  • Not share your account credentials with others
  • Notify us immediately of any unauthorized use of your account

Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

Account Termination

We reserve the right to suspend or terminate your account at any time if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account remains inactive for an extended period
  • We are required to do so by law

You may delete your account at any time by contacting our support team.

Subscription Plans and Billing

Free Tier

We offer a free tier that includes:

  • 3 diagram generations per month
  • Access to core features
  • No credit card required

Paid Plans

Details of paid subscription plans, if any, will be clearly displayed on our website. By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your subscription
  • Provide current, complete, and accurate billing information
  • Update your billing information promptly if it changes

Billing and Payments

  • Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected)
  • All fees are non-refundable except as required by law or as expressly stated in these Terms
  • We reserve the right to change our fees with 30 days' notice
  • Failure to pay may result in suspension or termination of your account

Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellation will take effect at the end of your current billing period
  • No refunds will be provided for partial billing periods, except as required by law
  • Upon cancellation, you will retain access to paid features until the end of your billing period

Acceptable Use

Permitted Uses

You may use the Service to:

  • Generate diagrams for personal, educational, or commercial purposes
  • Integrate with development tools via MCP
  • Share and export diagrams you create
  • Collaborate with others (when such features are available)

Prohibited Uses

You agree not to:

Violate Laws: Use the Service for any unlawful purpose or in violation of any applicable laws or regulations

Infringe Rights: Violate or infringe upon the intellectual property, privacy, publicity, or other rights of third parties

Harm the Service:

  • Attempt to gain unauthorized access to the Service or related systems
  • Use automated tools to access or scrape the Service without permission
  • Transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the Service or servers

Abuse the Service:

  • Create multiple accounts to circumvent usage limits
  • Resell or redistribute the Service without authorization
  • Use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Generate diagrams that infringe on others' intellectual property rights

Commercial Exploitation:

  • Use the free tier for commercial purposes beyond reasonable use
  • Attempt to reverse engineer or extract the underlying technology

Content Standards

When generating diagrams, you agree that your input and resulting content will not:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Contain malicious or harmful content
  • Impersonate any person or entity
  • Contain false or misleading information

Intellectual Property Rights

Our Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content (excluding user-generated content), is owned by lymiq and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Your Content

You retain all rights to the input you provide to generate diagrams ("Input Content") and the diagrams generated by the Service ("Generated Content").

By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

  • Process your Input Content to generate diagrams
  • Store your Generated Content to provide the Service
  • Display your Generated Content to you and users you share it with
  • Use anonymized, aggregated data to improve the Service

License to Generated Content

Subject to your payment obligations (if applicable), we grant you a non-exclusive, non-transferable license to use, reproduce, distribute, and display the Generated Content for your personal or commercial purposes.

Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without obligation or compensation to you.

MCP Integration and Third-Party Services

Model Context Protocol

Our MCP integration allows you to generate diagrams directly from supported development tools (Claude Code, Cursor, VS Code, Windsurf). By using MCP integration:

  • You acknowledge that data is transmitted between your development tool and our Service
  • You agree to comply with the terms of service of the third-party development tools
  • You understand that we are not responsible for the functionality or privacy practices of third-party tools

Third-Party Services

The Service may integrate with or contain links to third-party services. We are not responsible for:

  • The content, accuracy, or functionality of third-party services
  • The privacy practices of third-party services
  • Any damages or losses caused by third-party services

Your use of third-party services is governed by their respective terms and policies.

Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you also agree to our Privacy Policy.

Key points:

  • We do not collect or store cookies outside of authentication
  • We use Plausible Analytics for privacy-friendly analytics
  • We do not sell your personal data
  • You have rights to access, correct, and delete your data

Disclaimers and Limitations of Liability

Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will meet your specific requirements

Accuracy of Generated Content

While we strive to provide high-quality diagram generation:

  • We do not guarantee the accuracy, completeness, or reliability of Generated Content
  • You are responsible for reviewing and verifying all Generated Content before use
  • We are not liable for any errors, omissions, or inaccuracies in Generated Content

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYMIQ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUE, DATA, OR USE
  • ANY DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
  • ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR DATA OR ACCOUNT
  • ANY DAMAGES RESULTING FROM ERRORS, MISTAKES, OR INACCURACIES IN GENERATED CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless lymiq and its affiliates, officers, employees, agents, partners, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Input Content or Generated Content
  • Your violation of any applicable laws or regulations

Termination

Termination by You

You may terminate your account at any time by:

  • Deleting your account through your account settings
  • Contacting our support team
  • Ceasing to use the Service

Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Violation of applicable laws
  • Fraudulent or illegal activity
  • Extended periods of inactivity
  • At our sole discretion

Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and data after a reasonable period
  • You remain liable for all fees and charges incurred prior to termination
  • Sections of these Terms that by their nature should survive termination will survive

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Updating the "Last Updated" date
  • Sending you an email notification (for significant changes)

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions.

Informal Resolution

Before filing a formal dispute, you agree to contact us first and attempt to resolve the issue informally by emailing us at support@lymiq.io. We will attempt to resolve the dispute informally within 60 days.

Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or other matters.

The arbitration will be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association (AAA). The arbitration will take place in Tulsa, Oklahoma, unless otherwise agreed.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and lymiq individually. To the full extent permitted by law:

  • No arbitration or proceeding shall be joined with any other
  • There is no right or authority for any dispute to be arbitrated on a class-action basis
  • There is no right or authority for any dispute to be brought in a purported representative capacity

Exceptions to Arbitration

Either party may bring a lawsuit in court (without first engaging in arbitration) if:

  • The dispute qualifies for small claims court
  • The dispute involves intellectual property infringement
  • Either party seeks emergency injunctive relief

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and lymiq regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

No Agency

No agency, partnership, joint venture, or employment relationship is created between you and lymiq as a result of these Terms or your use of the Service.

Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Survival

Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Intellectual Property Rights, Disclaimers and Limitations of Liability, Indemnification, Dispute Resolution, and General Provisions.

All notices to you will be provided via email to the address associated with your account or by posting on our website. All notices to us should be sent to support@lymiq.io.

Acknowledgment

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

These Terms of Service are effective as of the date stated above and apply to all users of the lymiq Service.
